Before initiate debt recovery proceedings against individual or company debtors, it is important that you establish whether or not the debtor is worth pursuing; they may have defaulted on their debts due to a lack of money or estate.
There are various ways of investigating whether the debtor has any money or assets, whilst at the same time discovering whether they are currently experiencing financial problems or have significant debts.
Letter Before Action (LBA) is a formal letter that requests the payment of a debt to you and warns of the imminent issue of a court claim.
An LBA sets out what is owed from a debtor and provides a set time period – generally 7 days – in which to pay. This is an essential requirement of the debt recovery process. Before issuing any legal proceedings, a LBA must be sent. Very often debts being paid upon receipt LBA, with no further action being required.
If you send a LBA to your debtor but you do not receive a satisfactory response then the next stage in the legal process is to issue legal proceedings through the Courts.
Once a Court Judgment has been entered against a debtor it is then possible to ‘enforce’ that Judgment immediately. There are many different Enforcement methods that can be used depending on the circumstances of the individual case.
